Responsibilities
The Sr. Claims Litigation Specialist – Construction Defect is a vital member of our Claims Department, primarily responsible for managing complex, high-exposure Construction Defect claims and Third-Party Property General Liability matters. This role demands deep technical expertise in construction-related litigation, coverage analysis, and contractual literacy and risk transfer. The ideal candidate will possess strong analytical and negotiation skills, a collaborative approach, and the ability to navigate multi-jurisdictional legal environments with precision and confidence, while delivering exceptional service to insureds, agents, and internal stakeholders.
**Hybrid Model**Mon-Thurs in office, Fri-work from home.
Key functions include but are not limited to the following:
1. Working with strong technical expertise and limited supervision, the Senior Claim Specialist-Litigation effectively manages a caseload of Construction Defect, Major Case General Liability through coverage analysis, investigation, damage evaluation, litigation management, reserving, and resolution.
2. Develop positive business relationships with defense counsel and work with them closely to develop cost-effective litigation strategies and develop action plans to manage cases to an early conclusion. Ability to direct defense counsel to execute developed litigation strategies.
3. Prepare and present large loss reports.
4. Completion of decision trees to assist with detailed reserving analysis.
5. Establish timely and accurate claim and expense reserves.
6. Negotiate and convey claim settlements within authority limits.
7. Attend mediations, settlement conferences and trials.
8. Draft timely Reservation of Rights, Coverage Disclaimer, Tender Response Letters/Draft Tender Letters to others, along with other complex correspondence.
9. Understand how to interpret sub-contract agreements.
10. Maintain an effective diary system and document claim file activities in accordance with established procedures.
11. Manage file inventory to ensure timely resolution of cases.
12. Handle files in compliance with state regulations.
13. Provide excellent customer service to meet the needs of the insured, agent and all other internal and external customers.
14. Perform administrative functions such as document preparation, expense accounts, time off reporting, etc. as required.
15. Perform other duties as assigned.
Qualifications
• Minimum of 7 years prior experience handling large Construction Defect and Third-Party General Liability claims of more than $500,000.00 in aggregate exposure.
• Proven ability to identify and address coverage issues, complex investigations, timely/effective reserve management and ability to develop detailed action plans.
• Excellent interpersonal, verbal and written communication, and collaboration skills.
• Excellent negotiation, time management, and organizational skills.
• Strong knowledge of tort and contract law in our operating states.
• Effective presentation skills.
• Working knowledge of legal billing software, claim systems, spreadsheet and word processing software applications.
• Self-directed with the ability to work independently.
• Adjuster licenses in the states of NC, SC, and GA
